Three US lawmakers have asked four sportsbook operators and two prediction-market companies to explain how their VIP programs work and whether artificial intelligence shapes promotions aimed at individual customers. The official October 22 release identifies the recipients as BetMGM, Caesars, DraftKings, Fanatics, Kalshi and Polymarket.
Senator Richard Blumenthal and Representatives Paul Tonko and Valerie Foushee requested data on enrollment, customer wins and losses before and after joining VIP tiers, program revenue, perks, account-manager practices and safeguards for customers showing signs of harmful gambling. They also asked whether the companies use AI to select customers or personalize incentives.
The letters set a November 5 response deadline. SBC Americas reported that the inquiry extends an earlier exchange with FanDuel and now includes prediction markets alongside state-regulated sportsbooks.
The letters are congressional requests for information, not findings that any recipient violated a law or harmed a customer. Responses from the six companies were not included in the lawmakers' release, so their explanations and any resulting policy action remain pending.
