Nebraska's two mobile sports betting measures were heading toward defeat in unofficial returns, with 99.02% of precincts reporting on Wednesday morning. The proposals needed to pass together to create constitutional authority and an implementing framework for online sports wagering.
The Nebraska Secretary of State's results page showed Initiative 440 with 327,203 votes in favour and 398,412 against at the 5:58 a.m. Central update. Initiative 441 had 330,231 votes in favour and 395,330 against. Of the state's 1,322 precincts, 1,309 were fully reporting and 12 were partially reporting.
Initiative 440 would amend the state constitution so lawmakers could authorize sports wagers placed through internet platforms. Initiative 441 would establish the accompanying statute and give the Nebraska Racing and Gaming Commission responsibility for rules. G3 Newswire reported that failure of either proposal would prevent the planned market from taking effect.
Nebraska already permits sports betting at licensed racetrack casinos, but not through a statewide mobile system. The ballot campaign followed repeated unsuccessful efforts to pass online wagering legislation at the statehouse. Supporters emphasized projected tax revenue and regulation of existing offshore activity, while opponents focused on easier access to gambling and social costs.
The Nebraska Examiner described the late-night margins as a clear sign of voter opposition, while also noting that the count was not final. The Secretary of State continues to label the figures unofficial, so the outcome remains subject to canvassing and certification.
