Illinois officials have appealed a federal preliminary injunction that limits enforcement of state gambling laws against certain prediction-market contracts. Notices filed on October 30 take the consolidated dispute to the Seventh Circuit while the underlying cases continue in Chicago.
The injunction covers specified licensing, tax and enforcement provisions as applied to swaps, including sports event contracts, available through Commodity Futures Trading Commission-regulated markets. CDC Gaming reports that the combined litigation involves Coinbase, Kalshi, the United States and the CFTC.
Judge Martha Pacold previously found that the plaintiffs were likely to show federal preemption for at least some of the contracts at issue. Her October 2 opinion treated title contracts tied to sporting outcomes as likely swaps when they meet the statutory definition and trade on federally designated venues.
The appeal filing does not automatically suspend the injunction or determine the final legal status of prediction markets in Illinois. A case tracker records the notices but says no appellate stay or reversal has been verified. The Seventh Circuit will now consider the state challenge against a wider national split over whether sports event contracts fall under exclusive federal oversight or state gambling law.
