Brazil's Supreme Federal Court has placed a challenge to municipal lottery laws on its plenary agenda for November 4, 2026. The proceeding, ADPF 1212, will examine the constitutional limits on cities that create or authorise their own lottery and betting services.
The case was brought by the Solidariedade political party and is assigned to Justice Nunes Marques. According to iGaming Brazil, the dispute covers municipal laws and decrees in several states and asks whether lottery regulation falls outside the powers granted to local governments.
A nationwide interim order issued in December 2025 remains in effect. It suspended municipal lottery rules, licensing procedures and operating activity while the court reviews the dispute. The order also established daily penalties for municipalities and companies that continue unauthorised operations.
The November 4 session follows a separate public hearing on federal betting policy scheduled for the previous day. iGBRASIL reports that the justices may consider the interim order, the merits of ADPF 1212 or both. The eventual ruling could also determine how existing contracts between municipalities and lottery suppliers are treated.
